Visa Bulletin Position

May 2026 EB-5 is current for all chargeability areas except listed backlogged countries; China final action 2016-09-22; India final action 2022-05-01.

Concurrent Filing Window

If an EB-5 immigrant visa is immediately available, USCIS allows Form I-485 to be filed together with Form I-526 or I-526E, while the petition remains pending, or after petition action. This only works when a visa number is current and the applicant is adjusting status in the United States; it is not the consular-processing lane. USCIS also warns that concurrent EB-5 packets need separate fee payments for each form, rather than one combined payment.

Conditional Residence & I-829

Approval of adjustment of status or admission with an EB-5 immigrant visa grants conditional permanent residence for 2 years. The investor and included dependants then normally file Form I-829 during the 90-day period immediately before the second anniversary of conditional residence to remove conditions.

Sustainment & Set-Aside Reality
